Terms of Service(Agreement)
These Terms of Service (“Agreement”) outline the understanding between Miguel Andrade and the Client (“You”). By purchasing, booking, or participating in any in-person or online coaching service, you agree to these terms.
Services

Coaching and training sessions may include exercise programming, fitness assessments, nutrition guidance (non-medical), and accountability support.

Sessions may occur in person or online via video.

The Trainer may adjust or modify your plan based on progress, goals, or safety concerns.
Client Responsibilities

Disclose all relevant health conditions, injuries, and medications prior to starting.

Follow all safety instructions during sessions.

Maintain a safe and respectful environment during in-person or online sessions.

Notify the Trainer of any changes in your health or fitness level.
Limitation of Liability
Participation in physical training involves inherent risk. You acknowledge that [Your Business Name] is not liable for injuries, damages, or losses that may occur during or after training sessions, whether in person or online, unless caused by gross negligence or misconduct.
Payments & Booking
All payments must be made in accordance with the Booking & Cancellation Policy below.
Governing Law
This Agreement is governed by the laws of Ontario, Canada.
Refund & Reschedule Policy
Refunds

All sales are final. No refunds will be provided for completed or unused sessions.

Partial refunds or credits may be granted only at the Trainer’s discretion in cases of verified medical emergencies or injury preventing continued participation.
Rescheduling

Clients must provide at least 24 hours’ notice to reschedule a session.

Sessions canceled with less than 24 hours’ notice will be considered forfeited and charged in full.

If the Trainer cancels, a replacement session will be offered at no additional cost.
Privacy Policy
Information Collected
We collect and store basic personal and fitness information such as:

Liability/Health & Safety Disclaimer
By participating in any program or session offered by Miguel Andrade, you acknowledge and agree that:

You are voluntarily engaging in physical activity and assume all risks of injury.

You have consulted a physician and are medically cleared for exercise.

The Trainer is not a medical professional and cannot diagnose or treat health conditions.

The Trainer will provide guidance based on their professional certifications and experience, but you remain responsible for your own safety and health.
You release Miguel Andrade from any liability arising from injury, loss, or damages resulting from participation in the program, except in cases of proven gross negligence.
Booking/Payment Terms
Booking

Sessions must be booked in advance via [booking method: website, email, scheduling app].

Session times are confirmed upon payment.
Payment

Packages must be paid in full before sessions begin unless otherwise agreed in writing.

Late or missed payments may result in suspension of services.
Cancellation

Clients may cancel or reschedule with at least 24 hours’ notice.

Less than 24 hours’ notice = session forfeited.

Repeated last-minute cancellations may result in termination of the coaching agreement.

For ongoing monthly programs, 30 days’ written notice is required to cancel future billing.
Online Coaching-Specific Policies
These terms apply to all remote and virtual coaching clients.
Equipment & Enviroment

You are responsible for ensuring your equipment and workout space are safe and suitable for exercise.

The Trainer is not responsible for accidents or injuries caused by unsafe environments or equipment failure.
Video Sessions

By participating in virtual sessions, you consent to being seen and communicated with via video.

Recordings or screenshots may only be made with mutual consent for review or progress tracking.
Online Program Access

Digital programs and materials are for your personal use only. Sharing or distributing content is not permitted.
-
Access to online programs may be time-limited based on your subscription or payment plan.
Cross-Border Coaching
-
Services may be offered internationally. You acknowledge that local laws and regulations may differ, and you are responsible for complying with those applicable in your region.
